The Deed Restrictions are the devices which main
tain the high property values and residential character of Briarcroft (Houston), and assure the proper setback improvements from the streets and property lines. The Board of Directors of BPO is responsible for deed restriction enforcement, and meets each month to conduct corporation business, including reviewing plans for improvements to Briarcroft (Houston). All applicants must submit two sets of plans to the Architectural Control Committee (ACC) for their review. There is a form on the right side of the page which you can download and email to acc@Briarcroft.net. You need Microsoft Word to edit the form.

All exterior improvements or changes to a property must receive written approval from the Architectural Control Committee prior to commencement of any work. This includes, without limitation, room additions to the residence, garages and the conversion of same, servants quarters or outbuildings, carports, bay windows, chimneys, elevators, pool and pool equipment, external steps and entries, and extensive patios.



ACC POLICIES


NEW CONSTRUCTION


The BPO recognizes the need for some interim approvals. Possible home buyers may need to know if what they envision for their new home would fit into the BPO's concept for the neighborhood before they buy. Homeowners already in ithe neighborhood who wish to remodel also need to know if their concept will meet with approval prior to spending several thousand dollars for extensive plans. In both the above cases the ACC would require a site plan showing where the structures are to be located. Also needed is a sketch of the project showing the design. If all is in order the ACC will issue a temporary approval pending the completed constructin plans. The Board, however, reserves the right to suspend or revoke any form of an approval that is based on inaccurate or conflicting information. THE ACC MUST RECEIVE THE FINAL PLANS AND HAVE ISSUED WRITTEN APPROVAL BEFORE ANY CONSTRUCTION CAN BEGIN.

The Board and the ACC cannot stress strongly enough the need to provide supervision on construction sites to assure compliance with restrictions, ordinances, and rules. During construction iN Briarcroft (Houston) you must adhere to the following:

a. All fencing plans must be submitted for review and written approval by the ACC prior to any construction. Be advised that the Deed Restrictions provide for different policies regarding fencing depending on the location of the hme within the subdivision.

b. All approvals for iimprovements will expire 12 months after issue if construction has not commenced. An extension may be obtained if a written request confirming there have been no changes to the plans originally approved by the ACC. The BPO requests you complete your submitted projectbe completed within 18 months of the starting date. The completion of the project includes all landscaping, driveways and sidewalks. Should an extension be necessary, please advise in writing.

c. The City of Houston Noise Ordinance states that construction work can be done any day of the week, but only between the hours of 7:00a.m. and 8:00p.m. and the nosie level shall not exceed 75db(a), which would be measured by an PS Sergeant upon complaint.

d. Sidewalks must be passable at all times. When sidewalks are replaced, use the original Briarcroft (Houston) Pattern and complete construction of new sidewals immediately after the old one is removed. City of Houston Building Code Section 40-11 declares it unlawful for any person in any manner to obstruct the use by pedestrians of a sidewalk. UNDER NO CIRCUMSTANCES SHALL ANY VECHICLE BE ON ANY PART OF THE SIDEWALK.

e. Parking of construction vechicles is restricted to the side of the street the construction is taking place on. Under no circumstances should vechicles be parked in other property owner's driveways or parked in such a manner that would block said driveways. All illegal parking will be reported and the vechicles will be towed at the owner's expense. Vechicles are not to be parked on grass at any time.

f. All construction debris and other trash must be removed from the site at least once a week. No trash should be left exposed that would drift or be carried onto the adjacent property. Under no circumstances should the storm sewer inlets be used to discard trash or debris.

g. Porta-cans shall be placed as far back from the street as possible and must be cleaned and serviced on a regular basis. The right to use these temporary facilities shall end immediately upon the completion oof construction and removed immediately thereafter.

h. Building materials, trucks and other material or equipment shall not be placed upon or parked on the easement between the front of the property line and the street. City of Houston Building Code 40-7: declares unlawful any obstructions and/or encroachments in City right-of-way.

BRIARCROFT (HOUSTON) ACC SUBMITTAL GUIDELINES



The following is an outline of a variety of modifications, additions, and improvements of existing homes and home sites that are expected to be submitted to the ACC for review and approval. This includes complete redevelopment of home sites as well. The submittals are reviewed as to the project's conformity to Briarcroft's (Houston) latest Deed Restrictions amended in 1986. All modification requests must be approved prior to construction beginning.

The primary concern of the ACC in their review will be the exterior features and characteristics of the house and related structures along with the site layout and development.

The Deed Restrictions call for the submittal of at least two copies of the specific data requested below. These should be sent to the head of the ACC along with a completed ACC Modification Form. A third copy of the ACC Modification Request Form should also be sent to the management company. The ACC Modification Form is available at www.Briarcroft.net and in this directory.

SUBMITTAL DATA



PAINTING: Exterior only unless interior painting is somehow significantly exposed to the exterior *Color Samples

ROOFING: Replacing existing or new *Product data and/or samples indicating color

WINDOWS AND DOORS: Replacing or adding new units *Product data and/or drawings and color selectin

LANDSCAPING: Major or total front yeard landscape projects, or if mass planting is planned near street's *Landscape plan naming and showing location of plant material

FENCING AND GATES: Replacement or adding new *Site drawing showing relationship of fence and gate/s to property lines, street setback lines, the house and other structures. Provide elevation drawing of fencing and gate to show design. Information should include materials, finishes, height and other dimensions.

WALKS, PAVING, PATIOS, DECKS, SWIMMING POOLS: All on-grade improvements *Accurate dimensioned site drawing showing location of improvements relative to the house and other structures, all building set-back lines, property lines and easements. Note that all swimming pools are required to be fenced with a lockable gate.

CARPORTS, TOOL/STORAGE BUILDINGS, GAZEBOS, BABANAS, KENNELS: *Accurate dimensioned site drawing showing location of improvemwnt relative to the house, all set-back lines, property lines and easements. Provide dimensioned plan, elevation and section drawings of proposed structure showing construction, materials, finishes and colors. NOTE that structural elements of the above cannot encroach upon building lines or into easements.

EXTERIOR REMODELING OF HOME WITHOUT AN ADDITION: *Complete constructions drawings that include plan and elevations of all modifications. All material and finish changes need to be indicated and a complete color shedule submitted.

ADDITIONS TO EXISTING HOME: *Complete construction drawings that minimally incude floor plans, exerior elevations, typical wall section, foundation detail, roof plan, details of connection to existing house. Two story additions shll be designed and certified by a licensed structural engineer.

REDELOPMENT: Demolition of existing house, garage and construction of new home or major remodels *Complete coonstruction drawings for home, garage and all other improvements by an architect or professional building designer that include:

Site Plan Floor Plan/s
Exterior/Interior Elevations Wall Sections
Details Roof Plan
Foundation Plan and Details Framing Plan & Detail
Electrical, Plumbing & HVAC

*Foundation and framing shall be designed and certified by a liscensed structural engineer. *Also include estimated time of construction, construction costs estimate and name of builder.
*Photos of materials/finish/color, in lieu of samples, may be submitted
